Dutch Government Considers Amendments to WAMCA to Meet the Criteria of the EU Collective Actions Directive

12th May 2022

In February 2022, the Dutch Ministry of Justice (MoJ) proposed amendments to the Dutch class action act (WAMCA) to transpose the EU collective actions Directive. The MoJ states that the transposition of the Directive requires minimal changes to the existing Dutch law.

The amendments are now being considered by the Dutch Parliament. Instead of an oral debate, Members of the Parliament (MPs) submitted their comments and questions to the MoJ at the end of March. Based on the MoJ’s responses to their questions, MPs may submit amendments to the draft law.

The 8-page Bill and the 66-page Explanatory Memorandum can be found on the government’s dedicated website to the Directive here.
