Latest Amsterdam’s Court of Appeal’s Ruling Confirms Netherlands’ Status As A Major Transnational Litigation Hub

A ruling by the Amsterdam’s Court of Appeal confirms that the country has become a welcoming hub for transnational and international collective litigation.
As reported by the Dutch press, the Amsterdam Court of Appeal is allowing a claim from a large group of Ivorians against Trafigura to proceed. The case, which is reportedly supported by undisclosed hedge funds, alleges the company illegally dumped substances in their country 14 years ago. The court overruled a lower court, which upon reviewing the controversial history of this case, rejected it due to fears that any payout would be corrupted.
The case is yet another example of why the litigation funding industry should be transparent and also be the subject of strict government oversight.
